Welcome to ILM Fusion. These Terms of Service ("Terms") are a legal agreement between you and Transform Creatively ("Company," "we," "us," or "our") governing your use of the ILM Fusion platform, website, and services located at https://ilmfusion.org (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a school, district, organization, or homeschool family, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, you may not use the Service.

2. Description of Service

ILM Fusion is an educational technology platform that helps teachers, homeschool parents, and students connect academic content with Islamic knowledge. The Service uses artificial intelligence to generate:

• Lesson plans integrating secular academics with Islamic concepts
• Performance tasks and assessments
• Simplified explanations for students (Explorer path)
• Age-appropriate Islamic connections to academic topics

The Service is designed for educators, homeschool families, and students seeking to integrate faith-based perspectives into their learning.

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age to create an Educator account
• Students under 18 may use the Explorer path with parental or educator guidance
• Have the legal capacity to enter into a binding agreement (for account holders)
• Provide accurate and complete registration information (for account holders)

4. Account Registration and Security

To access certain features of the Service (the Educator path), you must create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

5. User Paths and Access

5.1 Educator Path

The Educator path requires account creation and provides access to:

• Full lesson plan generation
• Performance task creation
• PDF export and saving functionality
• Content history and management

5.2 Explorer Path

The Explorer path is available without account creation and provides:

• Simplified academic-to-Islamic connections
• Limited functionality appropriate for students and curious learners
• Session-based access without saved history

5.3 Usage Limits

New users receive 3 free generations. Additional usage requires a subscription. We reserve the right to modify usage limits and subscription terms with notice to users.

6. Subscription and Payment

6.1 Subscription Plans

The Service may be offered through free trials and paid subscription plans. Details of available plans, features, and pricing are available on our website. We reserve the right to modify our pricing and plans at any time, with notice to existing subscribers.

6.2 Payment

By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis according to your selected plan. All fees are non-refundable except as expressly stated in these Terms or required by law.

6.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. If you cancel, you will continue to have access until the end of your current billing period.

7. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable law or regulation
• Upload or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Use the Service to spread content that contradicts core Islamic principles or promotes sectarianism
• Misrepresent AI-generated content as divine revelation or binding religious rulings
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any part of the Service
• Use any automated means to access the Service or collect information from the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others or allow others to access your account
• Resell, redistribute, or sublicense the Service without our written permission

8. Intellectual Property Rights

8.1 Our Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by Transform Creatively and is protected by copyright, trademark, and other intellectual property laws. ILM Fusion is a trademark of Transform Creatively. You may not use our trademarks without our prior written permission.

8.2 Your Content

You retain ownership of any content you input into the Service. By using the Service, you grant us a limited, non-exclusive license to process your input solely for the purpose of providing the Service to you.

8.3 AI Generated Content

Content generated by ILM Fusion based on your inputs is provided for your use in educational activities. You may use, modify, and distribute AI generated content in your classroom, homeschool, or educational setting. However, you may not:

• Resell AI generated content as a standalone commercial product
• Claim AI generated content as your own original scholarly or religious work
• Present AI generated Islamic content as authoritative religious rulings (fatwa)

8.4 Islamic Source Materials

Quranic verses, hadith, and classical Islamic scholarship referenced in generated content remain in the public domain or are attributed to their original sources. ILM Fusion does not claim ownership of these sacred texts.

9. Disclaimers

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9.2 AI Generated Content

ILM Fusion uses artificial intelligence to generate educational content and Islamic connections. While we strive for accuracy and authenticity:

• AI generated content may contain errors or inaccuracies
• Content should be reviewed before use in educational settings
• AI generated Islamic content is educational, not authoritative religious rulings
• Users are encouraged to verify Islamic references with qualified scholars
• We do not guarantee that content will meet specific denominational preferences

9.3 Educational and Religious Decisions

The Service is a tool to assist educators and learners. It is not a substitute for professional educational judgment or qualified Islamic scholarship. You are solely responsible for:

• All educational decisions and curriculum choices
• Verifying the appropriateness of content for your students or children
• Consulting qualified Islamic scholars for religious rulings or guidance
• Ensuring content aligns with your school, family, or community values

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRANSFORM CREATIVELY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to indemnify, defend, and hold harmless Transform Creatively and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the Service

• Your violation of any rights of another party
• Any content you input or generate through the Service
• Your use of generated content in educational or religious settings

12. Termination

12.1 Termination by You

You may terminate your account at any time by deleting your account through your account settings or by contacting us.

12.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include violation of these Terms, fraudulent activity, or misuse of the platform.

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination will survive.
